TERMS OF USE — SMS COMMUNICATIONS CLAUSE

SMS MESSAGING TERMS & CONDITIONS

These SMS Terms govern your participation in Axel Property Management's text messaging program. By opting in, you agree to the following terms.

PROGRAM DESCRIPTION

Axel Property Management operates an SMS messaging program to communicate with prospective and current clients regarding:

• Property management service inquiries
• Rental availability and leasing information
• Lead qualification and consultation follow-ups
• Appointment confirmations and scheduling
• Non-marketing operational updates related to your inquiry or tenancy

This is a non-marketing, transactional/operational messaging program. We do not send promotional campaigns or third-party advertisements via SMS.

OPT-IN & CONSENT

By providing your mobile phone number and checking the consent box on any Axel Property Management form — including web forms, lead qualifier forms, or voice agent-captured data — you expressly consent to receive text messages from Axel Property Management at the number provided.

• Consent is not a condition of purchase or service.
• Consent applies only to communications from Axel Property Management and is never transferred to third parties.
• You must be the account holder or authorized user of the mobile number provided.
• You must be 18 years of age or older to participate.

MESSAGE FREQUENCY

Message frequency varies based on your inquiry type and the status of your interaction with our team. You may receive:

• An initial response or follow-up to your inquiry
• Appointment confirmations or reminders
• Status updates related to your property management or rental request

We will not send excessive or unnecessary messages. You may receive up to 5 messages per inquiry thread unless further communication is mutually agreed upon.

COSTS & CARRIER TERMS

Message and data rates may apply depending on your mobile carrier and plan. Axel Property Management is not responsible for any charges incurred through your mobile carrier as a result of SMS communications. Contact your carrier for details on your messaging plan.

OPT-OUT

You may opt out of receiving SMS messages at any time:

• Reply STOP to any message to immediately unsubscribe.
• You will receive one final confirmation: "You have been unsubscribed from Axel Property Management texts. You will receive no further messages. Call (610) 424-3744 for assistance."
• After opting out, no further messages will be sent unless you re-initiate consent.

Carrier support is not guaranteed for all carriers. Message delivery is subject to carrier availability and network conditions.

MODIFICATIONS & TERMINATION

Axel Property Management reserves the right to modify or discontinue the SMS program at any time without prior notice. Any material changes to these terms will be communicated through our website at www.axelpm.com. Continued participation following any changes constitutes your acceptance of the updated terms.

LIMITATION OF LIABILITY

Axel Property Management is not liable for:

• Delayed or undelivered messages due to carrier issues or technical failures
• Any damages arising from your reliance on SMS communications
• Unauthorized access to message content resulting from circumstances beyond our reasonable control

GOVERNING LAW

These SMS Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved in the courts of Lehigh County, Pennsylvania.
